The Supreme Court striking down race-conscious admissions programs in Students for Fair Admissions v. Harvard and Students for Fair Admissions v. University of North Carolina (SFFA) not only impacts institutions of higher education, but also serves as the proverbial slippery slope for challenges beyond education. Any organization with policies designed to recruit and advance diverse individuals may now face significant legal risk from private lawsuits by organizations eager to push the Court’s ruling into other areas, state attorney general investigations, and more.
